Terms & Conditions

Please read these Terms and Conditions ("Terms") carefully before using FontVibe (the "Service") operated by Funovate Technology LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Service

FontVibe is an online service that uses AI to design and generate images, with a particular strength in text and lettering designs. Generating images uses Credits. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. Account Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Credits and Purchases

4.1 Purchasing Credits

Credits are obtained through one-time credit packs or monthly subscription plans (see the Pricing Page for current plans and prices). One-time packs are charged once at the time of purchase. Subscriptions renew automatically every month at the same price until cancelled. Credits are non-transferable and may not be sold or exchanged.

4.2 Using Credits

Each generation consumes Credits; the number consumed depends on the model and settings you choose. Credits from one-time packs do not expire. Subscription Credits are granted at each monthly renewal and do not roll over to the next billing period. If a generation fails due to a system error, the Credits it consumed are returned to your account automatically. All Credits are forfeited if your account is terminated for violating these Terms. We reserve the right to modify Credit consumption with reasonable notice.

4.3 Subscriptions

• You can cancel at any time from your Dashboard. Cancellation takes effect at the end of the current billing period: you keep access until then and are not charged again.
• There are no prorated refunds for cancelling partway through a billing period.
• Plan changes take effect immediately. When upgrading, the prorated difference is charged immediately; when downgrading, the difference is applied to your next invoice.

5. Payments

All payments are processed through Stripe. Prices are listed in USD, and we do not charge consumption tax or other taxes on top of the displayed price. Because charges are in USD, your card issuer may charge a currency conversion fee. By providing payment information, you authorize us to charge the applicable fees to your payment method. You represent that you are authorized to use the payment method you provide.

6. Refund Policy

If the Service is defective

If a generation fails due to a system error, the Credits it consumed are returned automatically. For any other defect, contact us at hello@fontvibe.ai; we will review the issue and remedy it, for example by restoring Credits.

If the Service is not defective

Due to the nature of digital services, purchases cannot be returned for change-of-mind reasons, with these exceptions and limits:

• One-time credit packs: refundable if requested by email to hello@fontvibe.ai within 14 days of purchase and no Credits from the pack have been used.
• Subscription fees are non-refundable once the billing period has begun. Cancelling stops future renewals (see 4.3).

We reserve the right to deny refund requests that do not meet these criteria.

7. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Funovate Technology LLC and its licensors. You retain ownership of the prompts you input. The visual assets generated by FontVibe using your prompts are licensed to you under a non-exclusive, worldwide, royalty-free license for personal and commercial use, subject to these Terms.

You may not use generated assets to train competing AI models, or in any manner that violates applicable laws or third-party rights.

8. User Content and Conduct

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, or defamatory.
• Generate content that infringes on any third party's intellectual property rights.
• Attempt to reverse engineer or extract model weights from the Service.
• Use automated tools to access the Service in a manner that exceeds reasonable usage.
• Impersonate any person or entity.

We reserve the right to terminate accounts that violate these conduct requirements without refund.

8.1 Content You Share to the Gallery

When you choose "Share to Gallery" or otherwise make a creation public, you agree that:

• The image, together with its text, prompt, style, font, generation settings and any reference images you attached, is publicly visible to anyone, including visitors who are not signed in.
• Any user may view, enlarge and download it (subject to the download rules of their plan), use it as a reference image, recreate it with the same prompt and settings ("Recreate"), and edit it (including Vibe Edit, background removal and layer separation), and may share or publish the results for personal or commercial purposes.
• FontVibe may display it in the Gallery and anywhere on the Services (such as the home page and style, font, tag and use-case pages), let search engines index it, use it in our marketing materials, and create thumbnails, tags and other metadata for it.
• Works created from yours may show your work as their source, and you may be notified when that happens.

You can make a creation private again or delete it at any time. This stops new uses from that point on, but does not revoke downloads or derivative works that others made while it was public. Only share content you have the right to share, including any reference images you uploaded.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUNOVATE TECHNOLOGY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless Funovate Technology LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court, Japan. You waive any objection to such jurisdiction and venue.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
